This Indenture made this eleventh day of September in the year of our Lord one thousand eight hundred and ten between Thomas Moffet of the County of Washington in the State of Virginia and Mary his wife of the one part and Valentine Baugh of the County and State aforesaid of the other part Witnesseth That the said Thomas Moffet and Mary his wife for and in consideration of the sum of two thousand dollars current money to them in hand paid they do bargain and sell unto the said Valentine Baugh and his heirs one certain tract or parcel of land situate lying and being in the County of Washington aforesaid on the waters of the North fork of Holstein River in the Rich Valley

containing three hundred and thirty acres and bounded as followeth to wit Beginning at five white oak saplings in a deep hollow at the foot of a spur of pine ridge and running thence South twenty four degrees East one hundred and eight poles to a Walnut sapling and two hicories on a hill side North eighty three degrees East three hundred and eight poles crossing a creek to three white by an old path North five degrees West forty poles to a white Walnut and linn in a deep hollow North thirty degrees west thirty four poles to two buckeyes in said hollow North forty five degrees East ten poles to a hicory North twenty one degrees West forty six poles to a large poplar by a branch North thirty five degrees East forty poles to a white oak dogwood & black oak, North twenty four degreesWest sixty seven poles to a large white oak and small gum on the top of a spur of pine Ridge thence along the same South sixty three degrees west three hundred and forty seven poles to the Beginning with all its appurtenances to have and to hold the said tract or parcel of land with all its appurtenances, excepting however the dower of Mary Moffet the mother of the said Thomas in a small part of the said tract which goes no farther than John Moffetts line an East direction to a fence of Thomas Moffets at an old vacant field, now possessed by the said Mary and of which she is tenant for her own life only, unto the said Valentine Baugh and his heirs to the sole use and behoof of him the said Valentine Baugh and his heirs forever. And the said Thomas Moffet for himself and his heirs doth covenant with the said Valentine Baugh and his heirs that he the said Thomas Moffett and his heirs the aforesaid tract of land with its appurtenances, with the exception aforesaid unto the said Valentine Baugh and his heirs against the claims of all

persons whatever shall warrant and will forever defend In Witness whereof the said Thomas Moffet and Mary his wife have hereunto set their hands and Seals the day and year first above written

The Commonwealth of Virginia to James White & John McClellan gentlemen greeting. Whereas Thomas Moffett and Mary his wife by their certain Indenture of bargain and Sale bearing date the 11th day of September 1810 have sold and conveyed unto Valentine Baugh one certain tract or parcel of land in the said County of Washington containing three hundred and thirty acres and whereas the said Mary cannot conveniently travel to our Circuit Court for Washington County to make acknowledgement of the said conveyance. Therefore we do give unto you or any two or more of you power to receive the acknowledgement which the said Mary shall be willing to make before you of the conveyance aforesaid contained in the said Indenture which is hereunto annexed. And we do therefore command you that you do personally go to the said Mary and receive her acknowledgement of the same and examine her privily and apart from the said Thomas her husband whether she doth the same freely and voluntarily without his persuasion or threats and whether she be willing that the same should be recorded in our Circuit Court aforesaid and when you have received her acknowledgment and examined as aforesaid that you d_______ and openly certify us thereof in our said Court under your Oaths, s____ then ______ the said Indenture and this writ. Witness Andrew Russell clerk of our said Court the 11th day of Sept. 1810 in the 35th year of the Commonwealth.

     Pursuant to a Commission from Washington Circuit Court to us directed we have proceeded to examine Mary Moffet wife of Thomas Moffet privily and apart from the said Thomas her husband and do hereby certify the said Court

that the said Mary did in our presence declare that she willingly signed & sealed the writing hereunto annexed which was then shown and explained to her by us and consented that the same should be recorded. Given under out hands and seals this 11th day of Sept. 1810.

     At a Circuit Court held for Washington County the 1st day of October 1810
     An indenture of bargain and Sale between Thomas Moffet and Mary his wife of the one part and Valentine Baugh of the other part was proved in Court by the oath of Benjamin Clark Andrew Russell and John McClellan three of the subscribing witnesses thereto to be the act and deed of the said Thomas and together with the Commission annexed and certificate of the execution thereof ordered to be recorded.
