The Will of James Hutton of Washington County, Virginia


I James Hutton of Washington County in the State of Virginia do make and publish this my last Will and Testament in manner following. I give and bequeath to my well beloved wife Sarah, all my ready money and monies due by Bond note or otherwise, my dwelling House during her natural life all my household and kitchen furniture of whatever kind to be by her disposed of she may think fit. Also her saddle with its furniture and Bridle. I give and bequeath to my son Leonard Hutton my plantation whereon I now dwell with all its appurtenances to him and his heirs forever, requiring of him in consideration thereof to provide and lay in for the comfort and subsistence of his mother a sufficiency for her comfortable subsistence during her natural life and at the expiration of one year after her death to pay unto my daughters Mary Smith, Jenny Scott and Sarah Scott each fifty Dollars. I also give to my son Leonard my large Bible, my other Books to be equally divided amongst my four children viz. Mary Smith Jenny Scott, Leonard Hutton and Sarah Scott after the death of their mother, the rest of my Estate to be sold after my Death and out of the proceeds thereof my debts and funeral charges to be paid and the remainder to be equally divided amongst my three Daughters, Mary, Jenny and Sarah aforenamed. And lastly I constitute and appoint John Stewart and Leonard Hutton my son, Executors of this my last Will and Testament, revoking all former wills by me made and confirming this my last Will and Testament this 8th day of April 1803.

At a Court held for Washington County the 21st day of February 1815.
The last Will and Testament of James Hutton decd was exhibited into Court and proven by the oath of William Eakin one of the subscribing witnesses thereto who also deposed the he saw Samuel Scott sign his name as a witness in the presence and at the request of the Testator and that the said Samuel is now dead, he further deposed that William Ryburn the other subscribing witness is also dead. Ordered that the said Will be recorded. And on the motion of Leonard Hutton one of the Executors named in the said Will who took the oath of an Executor prescribed by law and entered into and acknowledged his bond with William Eakin and Moses Hutton securities in the sum of two thousand dollars conditioned as the law directs. A Certificate is therefore granted him for the probate of the said Will in due form.
