Will of James Reid

"I James REID, being old and infirm in body, but of sound mind and disposing memory do make this my last will & testament, hereby revoking all former wills by me at anytime made - -

1st - I direct that all my just debts and funeral expenses be paid as soon after my decease as conveniently may be.

2nd - I give and devise to my daughter Elizabeth M. TILSON and her children now in being and which may hereafter be born the following real and personal property namely one tract of land containing one hundred forty eight acres according to the old survey lying and being in the county of Washington, State of Virginia on the waters of the Middle Fork of the Holston River on the north and south sides of the river. Also one tract of land containing three (3) acres adjoining the tract aforesaid on the north side. Also one tract of land containing eighty acres more or less, adjoining the one hundred & forty [eight] acre tract on the south side.

These three tracts of land are adjacent to the lands of Geo. W. ALDERSON and George GRAHAM, and all my horses, cows, sheep, hogs, and stock of every kind, wagons, carts, ploughs, and other agricultural implements, my household and kitchen furniture and chattels of all kinds, except what I hereinafter bequeath and give to my other children and their heirs, my growing crops & provisions laid in for family use on and in connection with the said three tracts of land the property & its proceeds to be held to the separate use and benefit of my daughter Elizabeth M. TILSON and her children free from all liability to the debts and engagements of her husband Stephen TILSON, but I give the foregoing real & personal property to her and them on condition that they support and maintain comfortably Elizabeth W., my wife during her life and bury her decently when dead.

3rd - I appoint Benjamin REED Jr. Trustee to execute the foregoing trust.

4th - I give and bequeath to my son John A. REID one dollar ($1) in addition to the property I have already given him.

5 - I give and bequeath to the children of my son James REID, deceased, one dollar ($1) in addition to the property I gave their father during his life.

6 - I give and bequeath to my daughter Huldah BERRY one dollar ($1) in addition to what I have already given her.

7 - I give and bequeath to my daughter Mary HAWTHORN one dollar ($1) in addition to the property I have already given her.

8 - I appoint my daughter Elizabeth M. TILSON executrix of this my will.

In testimony whereof I have to this my will consisting of two sheets of paper set my hand to this the last sheet this 10th day of march in the year eighteen hundred and seventy one [signed] James REID

Signed, published & declared by the testator James REID as and for his last will & testament in the presence of us and in the presence of each other, who in his presence and at his request have hereunto subscribed our names as witnesses [signed] Wm. M. EDMONDSON [and] Seldon LONGLEY

At a Court begun & held for Washington County the 28th February 1876, the last will & testament of James REID dec'd was produced in Court & proved by the oath of Seldon LONGLEY one of the subscribing witnesses thereto & the hand writing of Wm. M. EDMONDSON the other subscribing witness thereto was proved by the oath of H. H. EDMONDSON & Wm. SNODGRASS and the said will was ordered to be recorded.
