JANE M. RYBURN & WILLIAM J. RYBURN TO WM. F. RHEA

Whereas on the 27th day of September, 1880 Daniel Trigg and Geo. E. Penn, Comrs. in the cause of Worley vs. Millard pending in the United States Court at Abingdon, sold the land of John Ryburn decd. situated, partly in Sullivan County, Tenn. and partly in Washington County, Va. consisting of about 400 acres at which sale Johnathan T. Hamby and Mary V. Davis became the purchasers of said land; and whereas on the 13th day of November 1880 the said J.T. Hamby and Mary V. Davis entered into an agreement with S.W. Ryburn, R.A. Rutherford, Chas. C. Carmack and W.J. Ryburn to the effect that if the last named parties would pay one-third of the debt and cost reported in the said cause of Worley vs. Millard that the said second named parties might keep the said John Ryburn land and have the Court make deed to them for the same; and whereas before the sale of said land as aforesaid, the same had been divided by a commissioner between the second named parties to the agreement aforesaid; and whereas by said division W.J. Ryburn became the owner of one hundred and fifty-eight acres of the said John Ryburn tract, the boundaries of which was shown by the plat of the commissioner who divided the same; and whereas Jane M. Ryburn is the owner of about 12 acres running between the two parcels comprising the 158 acres of said W.J. Ryburn; and whereas the said W.J. Ryburn is desirous of selling said 158 acres so as to pay his portion of the debt yet due under the agreement before mentioned and other debts which he owes and whereas the said Jane M. Ryburn desires to sell the 12 acres mentioned above to enable the said W.J. Ryburn to pay said debts. Now this deed made this 7th day of July 1885 by and between W.J. Ryburn and Jane M. Ryburn of the one part and Wm. F. Rhea of the other part. Witnesseth that for and in consideration of the sum of nine hundred dollars in hand paid the receipt whereof in hereby acknowledged, the said parties of the first part have this day bargained and sold and do hereby convey with covenant of general warranty unto the said party of the second part all their right, title and interest in and to one hundred and seventy acres of land situated in Washington County Va. lying on the Main Road leading from Abingdon to Paperville Tenn. said 170 acres comprising 158 acres more or less, belonging to said W.J. Ryburn and about 12 acres belonging to said Jane M. Ryburn and lying between two parcels which make up the 158 acres of said W.J. Ryburn, the boundaries of said 170 acres being more particularly described in the plat of the commissioner who divided the land between the Ryburn heirs. To have and to hold said one hundred and seventy acres of land unto the said Wm. F. Rhea and his heirs forever. It is further the intention of the said W.J. Ryburn that the said Wm. F. Rhea shall be entitled to all the rights and benefits of an agreement entered into on the 13th day of Nov. 1880 between J.T. Hamby and Mary V. Davis of the one part and W.J. Ryburn, S.W. Ryburn, R.A. Rutherford and Chas. C. Carmack of the other part, to which he the said W.J. Ryburn is entitled to, or may be entitled to, it is further agreed that the said Jane M. Ryburn reserves the right to use and occupy during her natural life that part of the dower interest assigned her, which is embraced in the one hundred and seventy acres hereby conveyed, the dwelling house which is situated upon one hundred and seventy acres being also located upon said dower interest. Witness the following signatures and seals this the day and year first above written.
