James Kincannon of Washington Co., Virginia

To my well beloved wife, Sarah my 3 work horses and black filley, four milch cows, her choice of my cattle, all my flock of sheep & all my stock of hogs, all my grain of whatever kind now made on my plantation, all my household & kitchen furniture of whatever kind also half my cash bonds, notes and book debts to her own use, my dwelling house, half my plantation, farming utensils together with one moiety in the Negroes, Charles, Noka & Murr during her natural life.

To James Kincannon, son of my brother Andrew the remaining half of my plantation, Negroes & farming untensils also my still, on condition he come within one year after my decease and live on the same during the natural life of my said wife Sarah and at her decease to have all my lands and appurtenances with the Negroes – should James choose not to comply then the whole to him named to my wife Sarah during her natural life & after her death my executors to sell it and divide it among my brothers and sisters to wit Andrew [very dark], Frank, Mathew, George Kincannon _______,

to David Kincannon son of Frank a Bay mare lately got into my possession

to James Kincannon son of George a Bay mare raised on this plantation and my rifle

to my brother George Kincannon my best suit of clothes & new great coat and also my Indentured boy John Hall with his Indenture until he is of age at which time said George pay him his freedom dues

In case James does comply with the requisitions of this will the remaining part of my stock of cattle to remain on the plantation in common with his Aunt Sarah. The remaining Moiety of my money, bonds, notes and book debts after paying my lawful debts to remain in the hands of my executors to be by them applied to the best advantage of my brothers and sisters and to them equally divided after the death of my beloved wife Sarah.

In case of said James not complying the said remaining stock of cattle to be by my executors sold and applied as the money above directed.

And lastly I do appoint John Stewart and William Beattie executors

18 Feb. 1812 will exhibited and proven on oath of John Porterfield; David Beatie states that the signature on the will as witness appears to be his but he has no memory of attesting said will.

20 Oct. 1812 Catherine Kincannon resigned her right to administer the estate on the condition that James Kincannon, her nephew, be appointed, the executors named in the

will having signified in writing that they do not wish to act. James Kincannon took oath of administrator with Joseph Cole, Peter ____ and Jonas Smith security with bond in the amount of $10,000
