The last will and testament of Samuel Edmiston Sr. of Washington Co., Virginia

1. executors to collect all just debts due me and from proceeds pay all just demands against my estate.

2. to son David Edmiston 300 acres of my land on waters of Elk River, negro woman Peg, negro boy Kiah, a good horse and saddle, one of my beds, a decent support from the farm on which I now live for his natural life or as long as he chooses to live there, also 2 milch cows; property in fee simple.

3. to daughter Mary during her natural life, not in fee simple, 300 acres of land on waters of Elk River, negro girl Peg, negro boy Charles, a good mare, 3 beds, $100 in cash; negros, mare and beds are now in her possession. Should Mary have heirs the property shall pass to them, if not it shall revert to my heirs jointly.

4. to son Samuel the tract of land on which I now live in fee simple; he is to provide my son David with a decent maintenance as long as David chooses to live with him; if Samuel does not comply, 100 acres of the land is to be disposed of by my executors for David’s benefit unless Samuel gives bond with good security to my executor to fulfill the conditions of this request. It is my will that Samuel be bound to support David as long a David remains single and no longer.

To son Samuel my negro men Tom and Demy, my negro woman Phillis and her children, Bob and Syney, my negro woman Esther and her children, Ned, Rose and John; 3 beds and bed furniture; residue of my personal property and money except monies necessary to secure title to Elk River lands. I leave my old negro man Harry in the care of my son Samuel.

5. to son John 1000 acres of my land on waters of Elk River in fee simple

6. to grandson Samuel Edmiston 300 acres of land on waters of Elk River in fee simple

7. to grandson Samuel Edmiston Watson 300 acres of land on waters of Elk River in fee simple, and $150 to be paid by my son Samuel.

8. to grandson Samuel Edmiston Gilmore 300 acres of land on waters of Elk River in fee simple.

I authorize and direct my executors to make title to John M. Estill and Benjamin Estill jointly to 1,500 acres of my land on waters of Elk River agreeable to a bond executed by me to said Estill. Also to convey to David Martin a tract of land lying in Washington County on the south side of the Middle Fork of the Holston River containing 7 acres and patented in my name. Lands on Elk River are in dispute; any loss is to be apportioned among devisees in proportion to the quantity bequeathed to him.
Appoint my two sons, John and Samuel, and Major Thomas Edmiston my executors revoking all former wills.
