I Peter S. Hanby of the county of Washington and state of Virginia……..

- to beloved wife Catherine N. Hanby all land during her widowhood except about one hundred acres to son William Alexander Hanby to be laid off the lower end. Also one Negro boy named James and personal property consisting of horses, hogs, cattle, sheep, and household and kitchen furniture.

- to oldest daughter Nancy Catherine Hanby, now in Texas, give her $1.00

- to son Alexander Hanby about 100 acres of above named land to be laid off of the lower end as follows:

Beginning in the road near the house and spring in which Mrs Meek [?] now lives running eastwardly so as to include the house and spring and the farthest NE field [ ? ] the hollow to A. F. Bradleys line thence with the same to the tops of the mountain thence along the tops of the mountain with my line to or near the meeting house thence around the meeting house to an opposite direction to the mouth of the lane thence to the beginning.

- to son William A. Hanby and daughter Marian Wallace Hanby give Negro woman Judy and two of her children, one boy named Edward and girl named Alcey Ann their increase to be equally divided between them.

- provided that son William Alexander Hanby acts in accordance with his guardian; if he should not act in accordance with the wishes of said guardian then said guardian must use his best discretion and if he thinks best give his portion of the land and property to four of my other children, namely Marian W. Hanby, to have his portion of the Negro to herself. And his portion of the land to be equally divided between Marian W. Hanby, Polly F. Hanby, John D. Hanby, and Sally J. Hanby. Also the Negro boy James together with all the personal property that is left to my wife Catherine A. Hanby, is to be equally divided between my three younger children, namely Polly F. Hanby, John D. Hanby, and Sally J. Hanby, when Catherine ceases to be my widow. Also the land that I gave my wife Catharine N. Hanby is to be equally divided between four of my children namely Marian W. Hanby, Polly F. Hanby, John D. Hanby, and Sally J. Hanby, when the said Catherine N. Hanby ceases to be my widow.

- Negro girl Pleasant to be sold and the proceeds to be applied to payment of my debts.

- appoint brother Jonathan T. Hanby guardian of my son William A. Hanby during his natural life and give to him as his necessities may require.

- appoint brother Jonathan T. Hanby executor

exhibited and proved in court 28 July 1856 by oath of William R. Rhea and Daniel Whitaker. Jonathan T. Hanby took oath of executor with $8,000.00 bond. John S. Bradley and Thomas Moore [?] securities.
