Will5 Feb 1892 Mary wrote her will on 5 Feb 1892, three days before her death. She left her mother her own interest in the farm on which her mother lived. At her mother's death it was to go to Mary's sister Rachel Hutton and Mary's niece Eliza R. Hutton. If they died before Mary's husband he was allowed a dower right to the land. Following the death of all parties the land was to be sold and the proceeds divided among Mary's brothers. Mary also left a household item from her personal estate to each of her husband's children and their spouses. She left $5 to William Carmack, the grandson of her husband's deceased daughter, Elizabeth. The remainder of her personal estate was to go to her husband. After his death it was to be sold and divided equally between Mary's sister Rachel, her niece Eliza, and her husband's children.1

Burial She was buried at Old Glade Spring Cemetery in Washington County, Virginia.5
Probate Recd24 Jun 1895 Settlement papers for Mary's estate were recorded in Washington County on 24 Jun 1895. William, as Mary's executor, presented an accounting that showed assets of $101 from the appraisement of Mary's personal property, $12.90 from the sale of land to H. Humphreys and $30 received from Mrs. Isabella Hutton. In addition to medical and legal bills, payments equalling $14 or $14.51 were made to: John D.G. Ryburn, Rachel M. Hutton, S.L. Ryburn, Patrick Ryburn, W.J. Snodgrass, Mary McRyburn and Eliza R. Hutton. In addition smaller payments of cash were made to family members who in the will had been left specific items. For instance, Patrick, John and Samuel Ryburn, as well as William Snodgrass, were each to receive a quilt. It appears that instead they may have received an additional $3 each from the sale of Mary's estate. Likewise, Elizabeth Ryburn, Mary Mc (Ryburn) Ramsey and Sarah Snodgrass were each to receive a table cloth. Instead (or in addition) they received a 50 cent payment from the estate. Emmy M. Hutton received $2; William, as executor, was allowed a payment of $18.7
