Will of Mary Ellen Ryburn

Know all men by these presents that I, Mary Ellen Ryburn of the County of Washington, State of Virginia, being of sound mind and disposing memory make this my last Will and Testament, all other Wills heretofore made by me having been revoked.

1st I direct that my executor pay all my just debts and funeral expenses.

2nd I direct that the rents of my land shall be applied to the payment of a debt that I owe Thomas Palmer so that my husband shall never be annoyed with the payment of said debt.

3rd I give and bequest to my Mother all my interest in the farm on which she lives during her natural life; at my Mother’s death I direct that it shall go to my sister Rachel M. Hutton and my niece Eliza R. Hutton during their natural life; at their death I direct that my husband shall dower on said lands during his natural life; After the death of all the parties hereinbefore mentioned, I direct that the said land shall be sold and the proceeds shall be equally divided between all my brothers.

4th I direct a small piece of land which I own, being a part of the Samuel Buchanan farm, be sold by my executor, either privately or publicly according as he may think best and the proceeds applied to the payment of my just debts and funeral expenses.

5th I give and bequeath to my stepson Patrick Ryburn, one nice star quilt.

6th I give and bequeath to Elizabeth Ryburn, wife of Patrick, one Table cloth.

7th I give and bequeath to John D. G. Ryburn, one Hexagon Woolen bedquilt.

8th I give and bequeath to Mary Ramsey, one Table cloth.

9th I give and bequeath to Samuel L. Ryburn one dark Woolen quilt

10th I give and bequeath to Emma Ryburn wife of Samuel L. one Table cloth.

11th I give and bequeath to William J. Snodgrass one fence row Calico bedquilt.

12th I give and bequeath to Sarah E.M.M. Snodgrass one Table cloth.

13th I give and bequeath to my niece Una May Hutton daughter of my brother Samuel J.M. Hutton, my saddle.

14th I give and bequeath the remainder of my personal property not heretofore disposed of, to my husband during his natural life. At his death I direct the said property shall be equally divided between my sister Rachel M. Hutton and my niece Eliza R. Hutton, and all my husbands children. Provided that should Eliza R. Hutton die before my husband, I direct that the bequest made to her, in this section, shall go to my brothers.

15th I specially request my Husband to defend my rights and interest in the home farm, for the benefit of my sister and niece.

16th I give and bequeath to William R. Carmack (Grandson of my husband) $5.00 out of the proceeds of the land which I have directed to be sold.

17th I hereby appoint my husband executor of this my last Will and testament without Security.


Signed by the testator and Benja Reed and William J. Snodgrass, witnesses, in the presence of the testator, and in the presence of each other, this 5 day of February 1892.

At a County Court began and held for Washington County the 22nd day of February 1892.

This day a writing purporting to be the last Will and Testament of Mary E. Ryburn deceased, was produced in Court and proved by the oaths of Benja Reed and Wm J. Snodgrass, the two subscribing witnesses thereto, and it is therefore ordered to be recorded as, and for, the last will and testament of Mary E. Ryburn deceased. Thereupon W.S. Ryburn the Executor named in said will, appeared in open court, and took the several oaths, of such as is prescribed by the law, and entered into and acknowledged a bond as such in the Sum of Five Hundred Dollars, without security, the testat__ requesting in her will that none be required of him. A certificate is therefore granted him for the probate of the said will of Mary E. Ryburn deceased in due form.
