The following data focuses on the Washington and Smyth Co. Hutton families. It includes deed abstracts, marriage, guardianship, and census records. Most information is pre-1850 with the exception of the Smyth Co. death records which continue past that year. I added my interpretation of the 1810-1830 census households in square brackets - just to encourage further discussion.

The first list of marriages Nicholas Reagan submitted to the Washington Co. clerks office was dated 1794 (probably June). But his list did not include actual marriage dates. His second list did include marriage dates, beginning with one in April 1794 and ending with one in Sept. 1796. It is impossible to know how many years were covered in the first list or when each marriage was performed. All that really can be stated is that any marriage on the list probably took place prior to April, 1794. In D.E. Brown's Washington Co. Virginia Marriages 1781-1853 Leonard Hutton's marriage to Mary Berry is listed above several other Hutton marriages. Leonard and Mary's marriage was performed by Charles Cummings in Sept. 1791. Because the entries below it in Mr. Brown's book are preceded by a slash mark, rather than a date, some researchers have applied the Sept. 1791 date to the entries below it. Mr. Wheeler's scans of the clerk's record from the minister's returns (which images are included in his book) clarify that the marriages listed below Leonard Hutton and Mary Berry were definitely not performed in Sept. 1791 and in fact without a Bible or other record, we cannot say for sure when they were performed.

John HUTTON conveyed the land to his son Leonard Hutton on 17 Aug. 1797 without having discovered the error. The heirs of John HUTTON therefore released their interest in the 15 acres to Leonard HUTTON. Pursuant to notice given by virtue of a warrant issued 5 March 1839 under the provisions of an act of the General Assembly entitled "an act to explain and amend an act reducing into one the several acts concerning forcible entries and detainers" on the complaint of Mary Ann HUTTON that William HUTTON unlawfully witholds from her the possession of a tenement containing 4 acres in Washington Co; Defendant failed to appear and jury selected. They found that the defendant did, at the time the complaint was filed, hold possession against the consent of the plaintiff, but not for 3 years, and that the plaintiff had the right of possession. Therefore the plaintiff was to recover the tenement and her costs.

If the said Morgan shall make to sd David and Mahlon Hutton a good deed whenever the above sums with interest are paid then this obligation to be void, else to remain in full force.

Signed Mary A. HUTTON (her mark), Martha Ann PAFFORD (her mark), Barbary Emaline HUTTON (her mark), John H. PAFFORD (his mark), William HUTTON, Charles W. SCOTT, E.E. SCOTT (her mark). [Note: when the deed was copied in to the deed book in 1864 the clerk entered E.E. Scott and Charles W. Scott's signatures. However Eliza E. Hutton and Charles Scott were not married when the sale was made in Jan. 1860. Hence the initial acknowledgement of the deed, dated 25 Feb. 1860, included the name Eliza E. Hutton. A second acknowledgment, bearing the names Charles W. Scott and E.E. Scott, was added 12 March 1864 at Smyth County. Deed recorded March 14, 1864.]
