Will6 Jan 1859  James wrote a very detailed will on Jan. 6, 1859. He remembered James Fullen Ledbetter, Dorcas Ann Ledbetter, Sally K. Ledbetter and Mary Ann Ledbetter, who were the children of James' deceased daughter Ann W. Ledbetter and her husband Herbert M. Ledbetter. James appointed his son Aaron H. Hayter as the children's trustee.

James left his daughter Esther F. Campbell the tract of land in Sullivan Co., Tennessee on which she resided. James noted that he had already given his son Aaron H. Hayter the tract of land on which Aaron lived. James's son James Edmondson Hayter received the land on which he lived, which James described as part of the Christopher Haynes tract.

James devised the land on which he himself lived to his daughters Dorcas M. Hayter and Sally Lynch, to be equally held or divided. James described the land as south of the center of the Main Rd, being the old tract conveyed to James by Lewis Toncray. James excepted about 5 acres lying between the center of the main road and the Virginia and Tennessee Rail Rd. James appointed Richard Lynch to serve as trustee for Dorcas M. Hayter in order to protect her interest from the claims of her former husband, Moses W. Nelson. James appointed his sons Aaron H. Hayter and James Edmondson Hayter, and his son-in-law Richard H. Lynch as his executor.5
