Ryburn deceased ) Be it Remembered that on the 30th day of April AD 1837 [sic] Nancy Ryburn Executor named in the last will and testament of John Ryburn dec'd filed in the clerks office of Franklin County aforesaid the last will and testament of the said John Ryburn dec'd and duly proved the same by _ P. St.John & George Holland two of the subscribing witnesses thereto which will and proof follows ___ these words ___ to wit

In the name of God Amen I John Ryburn of the County of Franklin and State of Indiana on the ninth day of April in the year of our Lord one thousand eight hundred and thirty five being weak in body but of sound and perfect mind and memory __ considering the uncertainty of this mortal life Blessed be Almighty God for the same I do publish this my last will and testament in manner and form following that is to say first and principally I commit soul unto the hands of Almighty God and my body to the earth to be decently buried at the discretion of my Executor hereafter named, and after my debts & funeral charges are paid I will and bequeath as followeth that is to say first

I give and bequeath to my beloved wife Nancy all my right title claim or privilege that I have or could in any __ claim on her real estate

I likewise will and bequeath unto my wife all the money notes and book accounts we have on hand at this time

I likewise will and bequeath that my wife is to have all the stock of any description with the exception of one horse and one yoke of oxen together with the crop of grain on the said premises, this __ and crop I will & desire my wife to have and to use at her own discretion

I likewise will and bequeath all the household and kitchen furniture to my wife except one copper kettle

I likewise will and desire that my horse oxen wagon and harnesses and all my farming utensils if any of them remains when I am gone hence to be sold and the proceeds divided amongst my four children equally

I will and desire that my son John hath my __ bible and rifle gun

I likewise will and desire that the rest of my books with that part of my fathers estate that is coming to me be equally divided among my four children,

And lastly I do hereby constitute and appoint my wife Nancy to be executor of this my last will and testament revoking and annulling all former wills by me heretofore made ratifying and confirming this and none other to be my last will and testament in testimony whereof

Franklin County) Be it remembered that on the 30th day of April A.D. 1838 personally appeared before Robert John Clerk of the Probate Court of the County aforesaid George Holland _ _ StJohn two of the subscribing witnesses to the last will and testament the within and foregoing testator lat [sic] of the County of Franklin aforesaid who being duly sworn __ oath say that the said John Ryburn signed and executed the within and foregoing will by setting his name thereto and sealing the same in their presence and that the said John Ryburn was of sound and disposing mind and memory at the time he signed the same & declared it to be his last will and testament and that they signed their names thereto at this request as witnesses

Now at this day the Record of the taking proof of the last will and Testament of said decedent taken by the Clerk of this Court in Vacation on the 30th day of April AD 1838 being examined by the court now here and the proceedings ____ examined and considered in this behalf. It is ordered by the Court that the proof taken as aforesaid be and the same is hereby approved and confirmed
