John and Sarah Davis, relict of Nathaniel Davis dec’d to Moses Cavet

This indenture made the 15th day of October, 1765 between John Davis and Sarah Davis, relict of Nathaniel Davis deceased of the county of Augusta of the one part and Moses Cavet of the other part Witnesseth that for and in consideration of the sum of 35 pounds current money of Virginia to the said John Davis son and heir by law of the foresaid Nathaniel Davis & Sarah Davis in hand paid by the said Moses Cavet at or before the sealing & delivery of these presents …….

…. Unto the said Moses Cavet in his actual possession now being by virtue of a bargain and sale to him thereof made by the said John Davis and Sarah Davis for one whole year by indenture bearing the date the day next before the __ of the date of these presents ..

…certain tract of land containing 115 acres held by patent bearing the date the 30th day of August 1763 lying and being in the County of Augusta on Buffalo Creek and bounded as followeth:

Beginning at a white oak on the west side of Buffalo Creek and running south 40 degrees East 40 poles crossing the creek to a white oak south 35 degrees west 200 poles to a pine southwest 74 poles south 60 degrees west 80 poles to 3 white oak saplins north 47 degrees west 32 poles crossing the creek to 2 white oaks saplins on the west side of the creek north 42 degrees east 356 poles to the beginning

…John Davis and Sarah Davis now at the time of sealing and delivering of these presents are seized of a good __ perfect and indefensible estate of inheritance in fee simple…

15 Oct. 1765 this release for land from John Davis and Sarah his wife to Moses Cavet was proved by the oaths of the witnesses thereto and ordered to be recorded

[Note: I believe the last entry which refers to Sarah as John Davis’s wife is in error. The wording in the body of the deed clearly states that John is the son of Nathaniel and Sarah Davis and Sarah is described as the relict of Nathaniel Davis, deceased]

[Note: Sarah’s mark, as copied into the deed book by the clerk, was fairly distinctive – being a circle with an almost vertical slash through it]
