John Kelly of Washington Co., Virginia

- to son James Kelly the land on which I live, containing 145 acres, part of a tract of land of 290 acres granted to me by the Commonwealth [of Virginia]; the other part I already sold & conveyed to my son Andrew E. Kelly.

- son James a mare to be his sole property

- son Andrew Kelly the tract of land deeded to him; bind him to pay Samuel Kelly 20 pounds, to Jane Kelly 20 pounds, to Patsy Kelly 20 pounds agreeably to the bonds given them, and the $8 that would have been coming to Robert Kelly had he lived, I devise equally to Jane Kelly and Patsy Kelly.

- daughter Elizabeth Robinson I have given her 20 pounds through Andrew E. Kelly which is paid

- residue of estate which will probably not amount to $50 exclusive of doctor’s fees:
     - daughter Jane Kelly one feather bed and furniture, 2 cows and calves, 4 sheep
     - daughter Martha one feather bed and furniture, 2 cows and calves, 4 head of sheep
     rest of household furniture to be equally divided between daughters Jane and Martha except one feather bed and furniture to son James

- from personal property and money acquired between the date of this my last will and my death Samuel Kelly should have $150; rest to be equally divided between my 3 sons Samuel, Andrew E. and James Kelly and daughters Peggy, Elizabeth, Jane and Martha except farming utensils to James

- Jane and Martha Kelly to live with James while unmarried.

- my 3 eldest sons, William, Henry and Anthony have already received their full share of my estate

- appoint two sons Andrew E. and James Kelly, and David Robinson executors and direct them to bury my body by the side of my wife Jane at Ebbing Spring graveyard.

Mark! These interlineations, namely except one feather bed and furniture left to my son James, - of – my, – of all the property and, - that Samuel Kelly shall have $150 and the rest, - Excepting the farm utensils, which I leave to James, - were made at the request of John Kelly Sr. , dec’d, and at the request of Andrew Kelly, James Kelly and Samuel Kelly, all sons and heirs of John Kelly and in the presence of only two of the witnesses to wit, Alexander Robinson and Joseph Pendleton: Andrew Edmiston and Robt L. Todd were not at home. The interlineations were written on the 11th of Dec. 7 days after the will was acknowledged by all the witnesses listed.
